These terms govern all tour purchases made through batchesandbrews.com.

1. Acceptance of Terms

By booking a tour through batchesandbrews.com or making a payment to Batches & Brews (operated by Kayjen Consulting LLC, a South Carolina limited liability company, "Company"), you ("Guest") agree to be legally bound by these Terms and Conditions in their entirety. If you are booking on behalf of a group, you represent and warrant that you have the authority to bind all members of your group to these Terms.

These Terms, together with the Liability Waiver & Release, constitute the complete and exclusive agreement between you and the Company regarding your tour participation.

2. Age Requirement — 21+ Strictly Enforced

⚠ All participants must be 21 years of age or older. No exceptions. Valid government-issued photo identification is required at pickup. Any guest unable to provide valid ID will be denied boarding with no refund.

The Company reserves the right to refuse service to any individual who cannot verify their age or who presents identification that appears invalid or altered. Denial of boarding based on age does not entitle the Guest to a refund under any circumstances.

3. No Refund Policy

ALL SALES ARE FINAL. Batches & Brews does not issue refunds for any reason, including but not limited to: cancellation by the Guest, illness, change of plans, inclement weather (unless the tour is canceled by the Company), failure to appear, or failure to meet the 21+ age requirement.

Cancellation by Guest: If you must cancel, the Company will make a good-faith effort to resell your spot(s) to another group. If your spot(s) are resold, the Company may, at its sole discretion, issue a credit toward a future tour. Credits are not guaranteed, are non-transferable, and expire 12 months from the date of issue.

Cancellation by the Company: The Company reserves the right to cancel any tour for any reason, including but not limited to: failure to meet the 8-person minimum booking requirement, severe weather, vehicle issues, or force majeure events. In the event of Company-initiated cancellation, Guests will receive a full refund or the option to reschedule.

No-Shows: Guests who fail to appear at the designated pickup location at the scheduled time forfeit their payment entirely. The bus will depart on schedule and cannot return for late arrivals.

Partial Groups: Payment is collected per person. If one or more members of a group cannot attend, refunds will not be issued for those individuals. The remaining group members may still participate in the tour.

The Company reserves the right to refuse or remove any Guest from a tour at any time, at the driver's or Company representative's sole discretion, for any of the following reasons:

Any Guest removed from a tour for conduct reasons forfeits their payment with no refund. The Company is not responsible for any costs or inconvenience arising from removal.

Guests are responsible for any damage they cause to the Company's vehicle. Costs of repair or cleaning (including excessive cleaning for vomiting, spills, etc.) will be charged to the booking party's payment method on file.

6. Alcohol Policy

On the Bus: The Company does not provide, sell, or serve alcohol on the vehicle. Guests are welcome to bring their own beverages (BYOB) on the bus. Guests are solely responsible for their own alcohol consumption at all times. The Company is not liable for any guest's decisions or actions related to alcohol consumption.

At Brewery and Venue Stops: All drinks at Munkle Brewing Co., Revelry Brewing Co., Edmund's Oast, and Dueling Pianos (if applicable) are purchased independently by Guests. The Company does not facilitate, negotiate, or guarantee any drink pricing, availability, or service at third-party venues.

Responsibility: Guests acknowledge that drinking alcohol is an independent personal choice and assume all risks associated with alcohol consumption. The Company expressly disclaims any liability for Guest actions, decisions, health consequences, or legal issues arising from alcohol consumption before, during, or after the tour.

7. Itinerary, Timing & Third-Party Venues

The Company will make all reasonable efforts to adhere to the published tour itinerary. However, the Company reserves the right to modify stops, timing, or routing due to traffic, weather, venue availability, or other unforeseen circumstances without prior notice and without liability.

Third-party venues (breweries, Dueling Pianos, etc.) are independently operated businesses. The Company makes no representations or warranties regarding their services, drink menus, food availability, hours, pricing, or conduct of their staff. Any disputes with third-party venues are solely between the Guest and that venue.

Dueling Pianos Table Reservation (Full Batch Tour): The Company reserves a table block at John King Grill's Dueling Pianos entertainment venue on behalf of the group. A $10 per-person door cover is payable directly to the venue on-site and is not included in the tour price. The Company does not control venue operations and cannot guarantee specific seating arrangements, performance schedules, or entry if venue capacity limits are reached due to extraordinary circumstances.

8. Photography & Media Release

By participating in a Batches & Brews tour, you grant the Company a royalty-free, perpetual, irrevocable license to use any photographs or videos taken during the tour for marketing, promotional, and social media purposes. If you do not consent, please notify the Company in writing at [email protected] before your tour date.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your participation in a Batches & Brews tour shall be resolved exclusively in the state or federal courts located in Charleston County, South Carolina.

To the maximum extent permitted by applicable law, you waive any right to a jury trial in connection with any dispute arising under these Terms.
