This Waiver is incorporated by reference into the Batches & Brews Terms & Conditions.

⚠ Important — Please Read Before Booking

By booking a tour with Batches & Brews or making payment through batchesandbrews.com, you voluntarily agree to this Liability Waiver and Release of Claims. You are waiving significant legal rights, including the right to sue Kayjen Consulting LLC and its principals, agents, employees, and contractors for claims arising from your participation in the tour. Read this document carefully before proceeding.

1. Parties

This Waiver is between you, the tour participant ("Participant"), and Kayjen Consulting LLC, a South Carolina limited liability company, doing business as Batches & Brews ("Company," "we," "us"). For purposes of this Waiver, "Released Parties" means Kayjen Consulting LLC, its members, managers, officers, agents, employees, contractors, drivers, successors, and assigns.

2. Voluntary Assumption of Risk

Participant acknowledges and voluntarily assumes all risks associated with participation in a Batches & Brews brewery crawl tour, including but not limited to:

Participant expressly acknowledges that the consumption of alcohol is a voluntary personal choice and accepts all risks associated with that choice. Participant assumes full personal responsibility for monitoring their own alcohol consumption and physical condition throughout the tour.

3. Release of Liability & Waiver of Claims

IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN A BATCHES & BREWS TOUR, PARTICIPANT, ON BEHALF OF THEMSELVES AND THEIR HEIRS, PERSONAL REPRESENTATIVES, AND ASSIGNS, HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION WHATSOEVER ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, INJURY, OR DEATH, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, WHILE PARTICIPATING IN A BATCHES & BREWS TOUR.

This release includes, without limitation, claims for personal injury, wrongful death, property damage, loss of income, and emotional distress, to the fullest extent permitted by the laws of the State of South Carolina.

4. Indemnification

Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Participant's participation in the tour; (b) Participant's breach of these Terms or this Waiver; (c) Participant's consumption of alcohol or controlled substances; (d) any damage caused by Participant to the Company's vehicle, venue property, or third parties; or (e) any injury caused by Participant to another person during the tour.

5. Third-Party Venues

Participant acknowledges that Munkle Brewing Co., Revelry Brewing Co., Edmund's Oast Brewing Co., John King Grill (Dueling Pianos), and any other venues visited during the tour are independently owned and operated businesses. The Company is not responsible for and expressly disclaims any liability arising from:

Participant agrees that any claims arising from their experience at a third-party venue are solely between the Participant and that venue.

6. Alcohol — No Service by Company

Batches & Brews does not serve, sell, supply, or furnish alcohol to participants at any time. All alcohol consumed during the tour is independently purchased by participants from licensed third-party establishments. The Company is not a licensed alcohol retailer or bartender and does not have custody, control, or responsibility for any alcohol consumed by Participants.

Participant expressly agrees that the Company shall not be liable for any injury, illness, death, property damage, or legal consequences arising from Participant's alcohol consumption before, during, or after the tour, regardless of where that alcohol was obtained.

7. Vehicle Safety & Driver Authority

The driver of the Company's vehicle has full and final authority over vehicle safety and passenger conduct at all times. Participant agrees to comply with all driver instructions immediately and without dispute. Failure to comply may result in removal from the tour without refund.

Participant acknowledges that seatbelts (where provided) must be worn when the vehicle is in motion. Participant assumes full responsibility for compliance with vehicle safety protocols.

8. Severability

If any provision of this Waiver is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

9. Governing Law

This Waiver shall be governed by the laws of the State of South Carolina. Any dispute arising from this Waiver shall be resolved exclusively in the courts of Charleston County, South Carolina.

BY COMPLETING A PURCHASE THROUGH BATCHESANDBREWS.COM, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LIABILITY WAIVER AND RELEASE IN FULL, THAT YOU UNDERSTAND ITS TERMS, AND THAT YOU VOLUNTARILY AGREE TO BE BOUND BY IT. YOU FURTHER ACKNOWLEDGE THAT YOUR ELECTRONIC PAYMENT CONSTITUTES YOUR ELECTRONIC SIGNATURE AND LEGALLY BINDING ACCEPTANCE OF THIS WAIVER UNDER SOUTH CAROLINA'S UNIFORM ELECTRONIC TRANSACTIONS ACT (S.C. CODE ANN. § 26-6-10 ET SEQ.).

If you do not agree to these terms, do not book a tour with Batches & Brews.
